Terms

Website terms of use.

These terms cover using this website, in plain English. They are not our client services agreement: the scope, price and terms for actual project work are set out in a separate written proposal with each client.

Who we are

This website, precisionsoftwareautomation.com.au (the “Site”), is owned and operated by Flynn Winstanley Pty Ltd (ACN 702 189 544, ABN 76 702 189 544), trading as Precision Software Automation (“we”, “us” or “our”), of Margaret River, Western Australia.

Accepting these terms

By using the Site, you agree to these terms. If you do not agree to them, please do not use the Site. Nothing here affects any separate written agreement we enter into with you for a project; where the two conflict for that project, the written proposal or agreement controls.

The Site is general information, not advice

The content on the Site, including guides, blog-style pages and anything written by our AI chat, is general information about our services and about websites, software and business automation. It is not professional, technical or legal advice for your specific situation, and you should not rely on it as such. Talk to Flynn before making a decision based on anything you read here.

Quote builder and website check estimates

The quote builder gives an indicative price range based on the options you pick. The free website check gives automated scores and suggestions generated from Google PageSpeed Insights and a light check of your page's HTML. Neither is a quote, an offer, or a guarantee of price, outcome or technical accuracy. A firm price and scope only exists once we have sent you a written proposal and you have accepted it.

The site chat and its AI assistant

The chat bubble on this Site is answered first by an artificial intelligence assistant, with Flynn able to see and join any chat. AI answers can be wrong, out of date, or not quite right for your situation. Nothing the AI assistant says is a binding offer, quote or commitment on our part. A proposal or agreement signed or confirmed by Flynn is what counts.

Your consumer guarantees

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) or any other law that cannot lawfully be excluded. Where our services are not of a kind ordinarily acquired for personal, domestic or household use or consumption, our liability for a failure to comply with a consumer guarantee is limited, to the extent permitted by section 64A of the Australian Consumer Law, to resupplying the services or paying the cost of having them resupplied.

Acceptable use

You agree not to, and not to try to:

  • use the Site for any unlawful purpose, or in a way that infringes anyone else's rights;
  • interfere with or disrupt the Site, its security, or any server or network connected to it;
  • use automated means to scrape, copy or extract content from the Site, other than normal search engine indexing;
  • submit false or misleading information through the quote builder, website check or chat, or misuse those tools to send unsolicited messages or run checks on websites you do not have permission to check; or
  • send us a phone number, email address or other personal information that is not your own, without that person's permission.

We may suspend or restrict access to the Site, or any of its tools, for anyone who breaches these terms.

Intellectual property

The Site, and everything on it, including its design, text, graphics, logos and underlying code, is owned by us or our licensors and protected by the Copyright Act 1968 (Cth) and other intellectual property laws. You may view and print pages of the Site for your own personal, non-commercial use. You may not reproduce, distribute, modify or commercially exploit any part of the Site without our prior written consent.

Project work we build for a client is owned on the terms set out in that client's written proposal or agreement, not by these website terms.

Links to other sites

The Site may link to websites or services run by third parties, such as Google, or the sites of clients and projects we feature. We do not control those sites and are not responsible for their content, accuracy or privacy practices. Linking to a site is not an endorsement of everything on it.

No warranty

We take care with this Site, but we do not warrant that it will always be available, uninterrupted, or free of errors. To the extent permitted by law, and subject to the consumer guarantees above, the Site is provided without warranties of any kind, express or implied.

Liability

To the extent permitted by law, and subject to the consumer guarantees above, we are not liable to you for any indirect, consequential or special loss arising from your use of the Site, including loss of profits or data, even if we have been advised of the possibility of that loss. Nothing in these terms limits any liability that cannot lawfully be limited or excluded.

Changes to the Site or these terms

We may change, suspend or discontinue any part of the Site at any time. We may also update these terms from time to time; if we make a material change, we will update the date at the top of this page. Your continued use of the Site after a change means you accept the updated terms.

Privacy

Our Privacy Policy explains what personal information we collect through the Site, including the quote builder, the site chat and the website check, and how we handle it. It forms part of these terms.

Governing law

These terms are governed by the law of Western Australia. Any dispute about the Site or these terms is subject to the non-exclusive jurisdiction of the courts of Western Australia. Before going to court, we ask that you talk to Flynn first, and if that does not resolve things, that we try mediation, for example through the Resolution Institute, before either of us starts court proceedings.
